Roadside Dangers

We circulated a Safety Bulletin to our retainer clients last month following a tragic roadside accident where two mechanics were struck and killed by a passing motorist.

Essentially, the court ruled that allowing workers to conduct road-side repairs was negligent, unless adequate safety precautions were put in place.

This case and judgement highlights that road-side accidents are not rare and therefore foreseeable for employers, who must exercise extreme care if allowing any roadside repairs to be conducted.
