Avoiding Run-Away Vehicles

A forklift driver was convicted of negligence, in May 2024, under S.28 & S32 of the NSW WHS Act, and workplace manslaughter under the state Crimes Act. He was sentenced to a two-year intensive corrections order and six months home detention.

Back in February 2021, a delivery truck driver was fatally crushed while strapping his load when he was struck from behind by a run-away 7.6-tonne forklift and fatally crushed against his truck.

The court heard forklift driver, who was also the yard supervisor, failed to park the forklift on level ground, and failing this he failed to ensure;

  • The forklift was parked horizontal to the slope of the driveway,

  • Lower the tines,

  • Ensure the rear wheels were left at 45-degree angle,

  • The park brake was correctly applied and functioning, and

  • Place a chock behind the rear wheels.

All forklift drivers need to be trained in the company rules, which need to include procedure for safe parking, and extra precautions when leaving plant unattended on slopes.
